1. Use of the Site
This website is owned and operated by WaterConnect Group LLC (“WaterConnect,” “we,” or “us”), a Florida limited liability company. This site provides general information related to water damage emergencies and offers a means for property owners to be connected with independent, third-party restoration contractors (“Independent Contractors”).
By accessing or using this site, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree, do not use this site.
2. No Restoration or Remediation Services
WaterConnect is not a restoration, remediation, plumbing, or construction company and does not perform, supervise, or manage restoration, cleanup, or repair services. All such work is performed exclusively by Independent Contractors who are not affiliates, members, managers, employees, agents, partners, joint venturers, or representatives of WaterConnect.
3. Independent Contractors
Any Independent Contractor to whom you may be connected through this site operates as a separate, unaffiliated business entity and is solely responsible for its own acts, omissions, representations, pricing, timeliness, insurance, licensure, qualifications, and performance.
WaterConnect does not control, direct, or supervise the Independent Contractors and makes no warranty or representation regarding their availability, quality, or results. All contracts for restoration or repair work are strictly between you and the Independent Contractor.
WaterConnect does not verify, warrant, or monitor the licensing, insurance coverage, background, or other qualifications of any Independent Contractor, and has no duty or obligation to do so.
4. Assumption of Risk
You understand and agree that all risks associated with any restoration, cleanup, or related work are borne solely by you and/or the Independent Contractor you choose to engage. You are responsible for verifying all credentials, insurance, and references of any Independent Contractor before authorizing work to begin.
5. Release and Disclaimer of Liability
To the fullest extent permitted by law, you release, discharge, and hold harmless WaterConnect Group LLC, its members, managers, employees, affiliates, representatives, agents, successors and assigns (collectively, the “Released Parties”) from any and all claims, actions, demands, losses, liabilities, damages, costs, and expenses (including attorneys’ fees) of any kind, whether known or unknown, arising out of or related in any way to:
- the acts, omissions, representations, pricing, or performance of any Independent Contractor;
- property damage, bodily injury, death, or health issues of any kind;
- mold, water, or structural conditions before, during, or after contractor services;
- delays, unavailability, business interruption, loss of use, or loss of income; or
- your reliance on any information provided on this site.
You acknowledge that WaterConnect has no duty to inspect, monitor, or guarantee any restoration work and that the site and all information are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of Liability
Under no circumstances shall WaterConnect Group LLC or the Released Parties be liable for any damages of any kind—whether direct, indirect, incidental, consequential, special, punitive, or exemplary—arising from or related to your use of this site or any connection with an Independent Contractor, even if advised of the possibility of such damages.
In no event shall WaterConnect’s total cumulative liability to you exceed one hundred dollars ($100.00), regardless of the theory of liability or number of claims.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply in all cases; however, they shall apply to the maximum extent permitted by law.
7. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.
8. Disputes and Venue
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of this site shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.
You waive any objection based on forum non conveniens or lack of personal jurisdiction.
9. Waiver of Class Actions and Jury Trials
By using this site, you waive any right to a jury trial to the fullest extent permitted by law and agree that any claim must be brought in your individual capacity only and not as part of a class, collective, or representative action.
10. Changes to These Terms
WaterConnect may modify or update these Terms of Use at any time without prior notice by posting the revised version on this site. Continued use of the site after any modification constitutes your acceptance of the updated Terms.
11. Entire Agreement
These Terms of Use constitute the entire agreement between you and WaterConnect regarding your use of this site and supersede any prior understandings or representations.
